REGULATION ON AMENDING THE TYPE ZONING REGULATION FOR PLANNED AREAS
ARTICLE 1 – Provisional Article 6 of the Type Zoning Regulation for Planned Areas, published in the repeated Official Gazette dated 2/11/1985 and numbered 18916, has been amended as follows.
“Provisional Article 6 – Prior to the date on which this article amendment entered into force; with respect to specific parcels; building permit applications made before or after the date on which the article amendment entered into force – relating to parcels for which a demolition permit application has been filed, or whose building has been demolished, or for which a risky structure assessment has been carried out, or for which risky structure assessment procedures have been commenced by obtaining a structure identification number through organisations licensed by the Ministry, or for which a construction contract has been concluded, or a project contract has been concluded, or a notarised undertaking or power of attorney has been obtained for carrying out construction or a project, or in order to construct a new building; for which an application has been made for subdivision, consolidation, or surrender to the road, or an application has been made to obtain a zoning status certificate, road elevation report, or staking-out sketch, or for which a soil and foundation survey report has been prepared – shall be concluded, provided that they are finalised by 1/1/2016, in accordance with the provisions of this Regulation or, at the request of the relevant party, in accordance with the amendment provisions of the Regulation dated 14/9/2013, 8/9/2013 and 1/6/2013, or in accordance with the legislation of the relevant administrations that was in force before 1/6/2013. However, this article provision may in no way be applied for the purpose of increasing the number of storeys and the floor area ratio of the building as determined by the plan, and no building permit may be issued for this purpose.”
ARTICLE 2 – This Regulation enters into force on the date of its publication.
ARTICLE 3 – The provisions of this Regulation shall be executed by the Minister of Environment and Urbanisation.
